By signing up on this application and by submitting your details and information herein you agree and consent to the following terms in respect of the collection, use and disclosure of your personal information. These terms should be read in conjunction with our Privacy Policy which also applies to your personal information.

This policy outlines our personal information management practices for all aspects of our business including from our relationships with customers, drivers, operators, users of our services and others who may contact us or about whom we may be provided with personal information.

Specifically, this policy outlines:

  • the kinds of personal information we collect and hold;
  • how we collect and hold it;
  • the purposes for which we collect, hold, use and disclose it;
  • your right to access and seek correction of it;
  • how you may complain about privacy matters;

There are some matters to which this policy does not apply. These are referred to below:

1. What kinds of personal information do we collect and hold?

The personal information we collect and hold is what is reasonably necessary for our business functions and activities. When we collect and hold personal information, it is of the following kinds:

  • Personal Identifying Information: Personal Identifying Information is information that can be used to identify or contact you  including but not limited to one’s name, address, email address, telephone number, account identifiers, account password, payment information, credit card information and other billing data.  We collect, receive and store Personal Identifying Information when you connect, sign up or register on or with the Site or other Services, or registers with you or your product or service and then, because of Company’s relationship with you, provides or makes accessible such information to us through our Services.  For example, you may provide Personally Identifying Information directly to us in connection with signing up, registering or interacting with Company on or through the Site, when you set up an account for Services, when you subscribe to email alerts, updates or newsletters, or when you respond to a survey, fill out a form, or complete any profile through the Site. As another example, a Third Party Source may provide such Personally Identifying Information when signing up as a driver with a company that uses our Services to collect driving data about such Third Party Source; and that company may then choose to share such Personally Identifying Information with us.
  • Personal Non-Identifying Data:  Personal Non-Identifying Data is information about your  activities or behavior or information that is otherwise about you , in any event, cannot be used to identify or contact you or which has been stripped of any Personal Identifying Information.  This type of information, would includes for example without limitation, an individual’s gender, city or state of residence, age, characteristics, driving behavior, driving locations and driving activities as well as data regarding particular trips one has taken, types of vehicles used and similar information.  We collect, receive and store Personal Non-Identifying Data when you directly provide it to us through the Site or Services (such as through sign-ups or registration or through use of a Service that collects or tracks such information)  or through you or  service that collects or tracks such information using our Services.
  • your personal details such as your name (including account username), addresses (including email addresses and website addresses), telephone numbers, account login details and passwords, age and gender, and certain personal details of your emergency contacts;
  • the reference number you provide or which we allocate to you when engaged in services which we provide or services procured or booked using our services;
  • what, how, when and where you have engaged in services which we provide or services procured or booked using our services;
  • details about your stated or likely preferences and your experiences with services which we provide or services procured or booked using our services;
  • details about your membership in any loyalty programs;
  • whether you have a connection with others whose personal information we may collect or hold, for example family members;
  • if you use social media or a mobile device to interact with us, any information that you allow the social media site or device to share with us; and
  • depending on the nature of your dealings with us or the services which we provide to you or which you may obtain or make available to others using our services, other types of personal information. Examples are:
    • where you are involved in providing transport-related services,identification, taxation, government or regulatory identifier (such as drivers licence details), and vehicle and insurance details;
    • personal information relating to any complaints you make or are made aboutyou, including recording of any calls in that regard;
    • personal information collected and held via financial or payment systems about the payment mechanism or method that you might use (including credit card details) and the payments you may make for our services or any services procured or booked using our services; and
    • personal information which is accessible from your use of on line sites or applications in which we have an interest or provide (such as messages for the purposes of issuing and receiving one time passwords and other device verification) and device- related or device-generated personal information. The latter might include your device details, device IDs, your location, network connections, network access and communication and session data.

Some of our services require us to collect sensitive information, for example health-related information or information which may be contained in images you make available to us, which may be appropriate if you are involved in the provision or procurement of transport services using our services, or to assist us in relation to any liability issues involving you. This information is only used to provide you with those services or to manage such issues and other directly related activities and purposes. You consent to our collection of this sensitive information and our use and disclosure of such sensitive information for the purposes contemplated by this privacy policy.

You generally have the option of not identifying yourself or of using a pseudonym when dealing with us. But not where this is impractical (for example when you transact online with us or you apply to provide transport-related services) or where the law or a court order provides otherwise.

2. How do we collect and hold personal information?

When we collect personal information about you, we do so by making a record of it. We do this when:

  • you register with us, for example when you create an account for any of our products and services;
  • you communicate with us online;
  • you take part in our promotions, competitions, testimonials, surveys and focus groups; and
  • you deal with us in other ways involving a need for personal information to be provided such as when you contact one of our call centres, fill in a form, log into our website or application or make a complaint. We may record all calls and so collect any personal information provided during such call

We may also collect personal information about you by accessing data from other sources and then analyzing that data together with the information we already hold about you in order to learn more about your likely preferences and interests.

We may sometimes collect your personal information other than from you directly. For example,

  • from other suppliers who, in common with us, have a relationship with you or have information about you;
  • from those to whom we have given access to our online sites (such as through application programming interfaces);
  • from those we regard as our business partners, our other customers or our driver partners;
  • from publicly available information and from third party ratings and feedback.

Our contractors and service providers who perform services for us, such as payment processing, fraud management, marketing, data analytics and identity verification and background checks may also provide us information about you.

Personal information we hold is generally stored in servers and other computer systems. These may be operated by us or by our service providers. In all cases, we have rigorous information security requirements aimed at minimizing risks of unauthorized access to, and loss, misuse or wrongful alteration of, personal information.

3. Why do we collect, hold, use and disclose personal information?

When we collect, hold, use and disclose your personal information, we do so primarily in connection with the provision, sale and promotion of goods and services which we provide or are provided or procured using our services and to improve on and enhance the range of those services and offerings.

For example, we collect, hold, use and disclose your personal information:

  • in connection with transport-related services by:
    • providing customer’s and driver’s personal information(including current location, photograph, ratings and vehicle information) to each other in connection with the arrangement of specific transport-related services and to facilitate communications between drivers and customers;
    • using your location data to record and verify trip and payment information if you provide or procure transport-related services using our services or are logged onto our website or application; and
    • facilitating the search of any missing property which may have been left behind by a customer in a driver partner’s vehicle or assisting with any police or regulatory enquiries;
  • to process and facilitate your payment for goods and services, including as required by law;
  • for verification of your identity;
  • to develop insights about you or to personalize your offerings or experience in using our services or services of our third party business partners, including drivers or to assist our service providers and third parties to conduct data analytics;
  • for research and development or to improve goods and services, for example in connection with safety and security and preventing fraud;
  • where you are involved in providing transport-related services, for criminal history and background checks (including verification of health information) and other manual processing checks regarding the verification of drivers and vehicles;
  • to assist in dispute resolution, investigating complaints and in inquiries and support;
  • for incidental or other purposes related to the provision of goods and services to you or the purposes referred to above. For example, we may disclose your personal information within the Kidzjet Group for Kidzjet Group’s internal operational purposes (including to help us provide our goods and services, and monitor and improve our goods and services), to service providers who assist us in our day-to-day business operations and as part of buying or selling businesses; and
  • as required or permitted by law, court order and any government, law enforcement or other regulatory body.

We may collect, hold, use and disclose your personal information for other purposes which are within reasonable expectations (these may relate, for example to acting on your requests; our involvement in relationships between customers, drivers and third party suppliers of goods or services to you) or legal reasons (for example where permitted by law).

4. Other privacy terms and limits of this policy

This is a policy. There may be additional privacy notices and terms relevant to you depending on the nature of your dealings with us and on our particular businesses. In particular, there are additional privacy terms in our terms concerning our online sites and applications and account registration processes. We have separate charters concerning our employees – this policy does not apply to the personal information of our employees in their capacity as such. This policy also does not apply to information which may be collected from an individual by a driver of a vehicle which is not provided by us. This policy does not include that of any third parties whose promotions we may facilitate or whose online locations may be accessible via links from our online locations.

The Services may include or interoperate with applications, services, features or functionalities provided by third parties. In connection with such third party applications, services, features or functionalities, you may send (or such third parties may get access to) certain information about or related to you or your activities therewith.  The use, storage and disclosure of such information by these third parties is subject to their own privacy policies.

Security and Protection of Your Information

Company is very concerned with safeguarding your information and protecting the security of your and Third Party Source’s Personal Identifying Information and Personal Non-Identifying Data.  We use appropriate, industry-typical security measures and technology to protect against unauthorized access to, or unauthorized alteration, disclosure or destruction of, user information covered by this Privacy Policy (excluding any such data that may be disclosed or publicly shared in accordance with this Privacy Policy).  In this regard, we employ administrative, physical and electronic measures designed to protect personal information from unauthorized access and disclosure and to safeguard such information against loss, theft, alteration and destruction. No method of security is 100% secure.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of unencrypted electronically stored “personal data” (as defined in applicable statutes on security breach notification) to you via email or conspicuous posting on or through the Services in an expedient manner and without unreasonable delay, insofar as these are consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Changing or Deleting Your Information

Company does not have a mechanism for you to review, edit or delete any of your information on or stored in the Services or otherwise by Company, and information may be subject to any applicable record retention policies that we may have in place. If you would like us to delete your (or a Third Party Source’s) Personal Identifying Information in our system, please contact us and we will consider making good faith efforts to accommodate your request, though we have no obligation to do so (and will not do so if we have any legal obligation to retain the record or legitimate business need to retain such information). See below for privacy contact information.  In such cases, we ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests because of the reasons stated above or because such requests are unreasonably repetitive or systematic, require disproportionate technical effort, relate to information that is incorporated into other databases or Services as permitted by this Privacy Policy, jeopardize the privacy of others, or would be impractical (for instance, requests concerning information residing on backup tapes or derivative information that is not separable), or for other reasons. Because of the way we maintain certain Services, after information is deleted, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.  We have no obligation to retain or store your (or any Third Party Source) data and information and reserve the right to delete such data and information at any time in our sole discretion.  From time to time, we may choose to implement certain data retention policies which may be specified on our website.

Cookies and Other Files

Like many services, websites or applications, we may use “cookies” or similar technologies to collect information. A cookie is a small data file that we transfer to a computer’s memory for record-keeping purposes. We may use cookies or such other technologies to improve the quality of the Services, including for storing user preferences and tracking user trends and for any of the other purposes permitted in this Privacy Policy.  We may utilize persistent cookies to save your registration/member ID and login password for future logins to the Services.  We may utilize session ID cookies to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage by Company users and web traffic routing on the Services. Unlike persistent cookies, session cookies are usually deleted from your computer when you log off from the Services and then close your browser. Third party advertisers on the Services may also place or read cookies on your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions or functionalities of the Services.

Log file information is automatically reported by your browser each time you access a web page. When you use the Services, our servers may record certain information that your web browser sends whenever you visit any website or utilize any other services or applications. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other information.  When you use the Services, we may employ clear GIFs (also known as web beacons) or similar mechanisms which are used to track the online usage patterns of our users anonymously. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.

International Transfer

Our Services are hosted in the United States.  If you or Third Party Sources use the Services from the European Union, Asia or any other country outside the United States with laws or regulations governing personal data collection, use and disclosure that differ from the United States laws and regulations, please be advised that through the continued use of the Services, you (or the Third Party Sources) are transferring information to the United States and you consent to that transfer.  Your and Third Party Source’s information may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us or use the Services, Company transfers personal information to the United States and processes it there, and your submission of such information represents your consent and agreement to that transfer.

Our Policy Toward Children

In order to use our Site and other Services you must represent and warrant that you are over the age of 13 in the sign-up process. Children under the age of 13 are not eligible to use the Services and must not attempt to sign-up with the Services and/or submit any personal information to us.   We do not knowingly collect personal information from any person who is under the age of 13 or allow them to register. If it comes to our attention that we have collected personal data from a person under the age of 13, we will delete this information as quickly as possible.

Links to Other Sites, Services and Applications

Our Services may contain links to, interoperate with, and allow you to share content to and from third party services, websites and applications. The fact that we link to a website, service or application or allow you to share content through these third parties is not an endorsement, authorization or representation that we are affiliated with that third party, nor is it an endorsement of their privacy or information security policies or practices. Other websites, services and applications follow different rules regarding the collection, use, storage or disclosure of the personal and other information. We encourage you to read the privacy policies or statements of the other websites, services and applications you use.

Limitation of Liability

Even though Company has taken reasonable commercial steps and efforts to prevent Personal Identifying Information and other information covered by this Privacy Policy from being accessed, used, intercepted or disclosed by unauthorized individuals in violation of this Privacy Policy, you should know and you acknowledge that Company cannot fully eliminate security risks associated with your information and Third Party Source information.  You expressly acknowledge and agree that uploading, posting, providing, storing, using, analyzing, transmitting, sharing and/or allowing access to Personal Identifying Information and other information on, through, in or to the Services, and the use of all such Services, are all done at your sole risk and responsibility.   You expressly acknowledge that Company is not liable for (i) any special, indirect, consequential, incidental or punitive damages, costs, or liabilities whatsoever arising out of or resulting from your use (or any Third Party Source’s use) of the Services, including from uploading, posting, providing, storing, using, analyzing, transmitting, sharing and/or allowing access to Personal Identifying Information and other information; or (ii) any loss, disclosure or use of your (or a Third Party Source’s) Personal Identifying Information or other information.
